Sub:- Guide line on Compassionate Ground appointment

 

1-      Circumstances in which compassionate appointment is made:

C.G. appointment relate to the appointments made of dependents of Railway servants who lose their lives in the course of duty or die in harness otherwise while in service or are medically incapacitated/decategorised.

2-      The main grounds for C.G. appointment are:

(a)    Death of Railway servants in the course of duty.

(b)   Death of Railway servants while in service.

(c)    Death of casual labor during service who have got T.S.

(d)   Death of casual labor who died due to accident on duty.

(e)    Medical Unfit for all category of regular employee

(f)     Medical decategories of regular employee.

(g)    In case of missing employees

3-      Persons eligible for compassionate ground appointment:

(a)    Widow/Widower of the employee.

(b)   Son/Daughter of the employee.

(c)    Divorce daughter of the employee.

(d)   Adopted son/daughter of the employee.

4-      Normal time limit for request for appointment

(a)    Within 05 years from the occurrence

(b)   G.M. can consider up to 20 years old cases in case of minor son/daughter.

(c)    Railway Board can consider more than 20 years old cases duly recommendation of GM

5-       Competent authority for processing approval of normal cases request made within stipulated period on C.G. cases

(a)    In HQ. CPO/GM

(b)   In Extra Div. Unit Concerned HOD

(c)    In Division DRM

6-      In case of other than death and request made beyond stipulated period and medical unfit/decategories cases

(a)    CPO

(b)   GM

7-      Minimum qualification

(a)    For Group-D Minimum passed Class-VIII (May be                 relaxed in case of widow)

(b)   For Group-C Minimum High School

8-     The application should be forwarded by the controlling officer of concerned department where the employee was working.

9-     Application form for request on C.G. appointment is given in ANNEXURE-A

10- After processing approval suitability test for Group-C and Screening for Group-D is conducted every month. The calendar is enclosed as ANNEXURE-B

There are two types of case:-

1-                 Totally incapacitated on medical ground / Medical unfit for all category

2-                 Medical decategorised – Found unfit for the post holding but fit for other medical category.

In cases where an employee has been medically invalidated / decategorised he may be kept on a supernumerary post in the grade in which he was working on regular basis till such time he is absorbed in a suitable post or till his retirement, whichever is earlier. There would be no occasion for an employee to be retired from service on medical ground after 29.4.99. Therefore, in such cases, the occasion to consider a request for appointment on compassionate ground of an eligible ward would not arise as per board’s letter dated 24.4.99

Compassionate ground is admissible in cases where an employee has been declared totally incapacitated for further service and he opts for retirement, request for appointment on compassionate ground of an eligible ward my be considered as per Board’s letter dated 18.1.2000.

In cases where medically decategorised employee before issue of letter dated 29.4.99 had taken voluntary retirement and he had neither been absorbed in an alternative employment nor adjusted against a supernumerary post after the issue of letter dated 29.4.99, the facility of allowing appointment on compassionate ground of one ward may be extended as per board’s letter dated 10.11.2000.

The facility of appointment on compassionate ground was also extended to an eligible spouse/ ward of totally incapacitated employees who were declared so after the issue of letter dated 29.4.99 and prior to issue of their letter dated 18.1.2000 and were also allowed to retire as per Board’s letter dated 11.4.2001.

Later on it has been decided that compassionate ground appointment may also be considered in favour of wife/eligible ward of such of the employees as were medically decategorised between 29.4.99 and 18.1.2000 and declared unfit to continue in the post they were holding but fit to hold posts with lower medical classification subject to the as per Board’s letter dated 06.3.02.

It is extended in the cases where dectagorisation has occurred after 14.6.2006 may be dealt in the same way as done prior to issuance of Board’s letter dated 18.1.2000.

All those employees medically decategorised after issuance of Board’s letter dated 18.1.2000 will also be covered under the conditions stipulated in para (4) of letter dated 14.6.2006 as per Board’s letter dated 02.11.2006.
